Agreement

These Terms of Service ("Terms") govern your access to and use of the Kyvenza website (the "Site") and the Kyvenza application (the "App"). By downloading, installing, or using Kyvenza, you agree to these Terms.

License

Trial

Kyvenza offers a 7-day free trial that unlocks full Pro features on your device. No payment is required to start the trial.

Paid license

When you purchase a license you receive a personal, non-exclusive, non-transferable right to install and use Kyvenza on Apple Silicon Macs that you own or control. Each license key may be used on one Apple Silicon Mac at a time. To move the license to a different Mac, open Settings → License on the current Mac, click Remove License from this Device, then activate the key on the new Mac.

What you may not do

• Share, resell, rent, or publicly distribute your license key
• Bypass, remove, or interfere with license validation or copy-protection
• Reverse engineer the app except to the extent allowed by applicable law
• Use Kyvenza to violate the Apple macOS licensing terms or any third-party operating-system license
• Use Kyvenza to run malicious software, to process data you do not have the right to process, or in a way that harms others

Pricing, payment, and taxes

Current prices are listed on the Pricing page. Final amounts and applicable taxes are confirmed in Stripe Checkout. You authorize us and our payment processor (Stripe) to charge the payment method you provide.

Refunds

We offer a 14-day refund on your first purchase if Kyvenza does not work for you. To request a refund, email [email protected] within 14 days of purchase. Refunds after the 14-day window are at our discretion. Refunded licenses are deactivated and must no longer be used.

Perpetual Fallback License

Kyvenza licenses are sold under a perpetual fallback model.

• 12 months of updates. Unless stated otherwise at checkout, your license includes one year of updates starting from the purchase date, shown as the "Updates Until" date on your key.
• Permanent right to use covered versions. Any version of Kyvenza released on or before your "Updates Until" date remains usable with your license indefinitely, even after the update window closes. You do not lose access to the versions you already had.
• Newer versions require renewal. Versions of Kyvenza released after your "Updates Until" date are not covered by the existing key. To use them you may purchase a renewal, which extends your "Updates Until" by another year.
• Enforcement. When you install a version released after your "Updates Until" date, Kyvenza will prompt you to renew. The app may disable create/start-VM actions until you renew, but it will not delete or damage any existing data, and you may at any time install an older covered version to continue working.

Service availability

We may change the app, including adding, removing, or modifying features, at any time. We do not guarantee uninterrupted availability of the license issuance backend or the website.

Third-party components

Kyvenza bundles Lume (an open-source, MIT-licensed VM runtime by the trycua/cua team) and relies on Apple frameworks. These components are subject to their own licenses, which apply alongside these Terms. We are grateful to the upstream maintainers for their work.

Disclaimer of warranties

Kyvenza is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that Kyvenza will meet your requirements, be uninterrupted, or be error-free.

Limitation of liability

To the maximum extent permitted by law, Kyvenza, its authors, and its service providers are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or use. Our aggregate liability for any claim arising out of or relating to these Terms or the use of Kyvenza will not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to defend and indemnify Kyvenza against claims arising from your violation of these Terms or your misuse of the app.

Termination

We may suspend or terminate your license and access if you materially breach these Terms. Upon termination you must stop using the app and remove the license key from your devices.

Changes to these Terms

We may update these Terms from time to time. Material changes will be noted at the top of this page with a new "Last updated" date. Continued use of Kyvenza after the update constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws applicable at the operator's place of business, without regard to conflict-of-law rules. Disputes will be resolved in the courts having jurisdiction there, except where mandatory consumer protection laws in your country of residence apply.
